A By-law to Provide for Tax Refunds for Eligible Heritage
Properties
WHEREAS Section 365.2 of the Municipal Act, 2001, S.O. 2001, c. 25 as amended (the
“Municipal Act”) provides that the council of a local municipality may establish a
program to provide tax reductions or refunds in respect of eligible heritage properties;
AND WHEREAS the Corporation of the City of Owen Sound (the “City”) did, by its by-
law number 2009-148 dated September 14, 2009, establish such a program;
AND WHEREAS Section 365.2, subsection (6) the Municipal Act provides that a lower-
tier municipality that passes a by-law under this section shall notify the upper-tier
municipality of the amount of taxes to be reduced or refunded for lower-tier purposes
under the by-law;
AND WHEREAS by a notice dated June 25, 2026, the City notified the Corporation of
the County of Grey (the “County”) that the amount of taxes reduced or refunded for City
purposes for the year 2025 totalled $23,244.86, which amount reflects a reduction of
twenty percent (20%) of taxes levied by the City on eligible heritage properties for
municipal and school purposes;
AND WHEREAS Section 365.2, subsection (7) of the Municipal Act provides that an
upper-tier municipality that receives a notice under subsection (6) may pass a by-law to
authorize a similar reduction or refund of taxes levied for upper-tier purposes.
NOW THEREFORE BE IT RESOLVED THAT THE COUNCIL OF
THE CORPORATION OF THE COUNTY OF GREY HEREBY ENACTS AS FOLLOWS:
1. That the amount of taxes rebated for County purposes for the year 2025 totalled
$23,244.86, which amount reflects a reduction of twenty percent (20%) of taxes
levied on eligible heritage properties as identified by the City pursuant to its by-law
2009-148, and shall be refunded.
2. The terms defined in the recitals above shall have the same meaning as if set out at
length in this by-law.
3. This by-law shall come into force and effect upon the date of final passing thereof.
ENACTED AND PASSED this 23rd day of July, 2026.

A By-law to add certain lands to the Grey County Road System
WHEREAS Section 52(1) of the Municipal Act, 2001 provides for an upper-tier
municipality to add a lower-tier highway, including a boundary line highway, to its
highway system from any of its lower-tier municipalities;
AND WHEREAS certain lands were established as public highways under the
jurisdiction of the Municipality of West Grey (“West Grey”), the Township of Chatsworth
(“Chatsworth”), the Township of Southgate (“Southgate”), and the Township of Georgian
Bluffs (“Georgian Bluffs”), as more particularly described in Schedule ‘A’;
AND WHEREAS the County of Grey has undertaken a road rationalization study to
more efficiently and effectively manage its road network;
AND WHEREAS on June 25, 2026, Committee of the Whole approved road assumption
and deletion by-laws to come forward to County Council for consideration through
adoption of the Urban Road and Road Exchange Task Force minutes dated May 26,
2026, and authorized the Warden and Clerk to execute the road transfer agreements;
AND WHEREAS Council for the County of Grey deems it expedient for the lands more
particularly described in Schedule ‘A’, the general location of which is shown on Maps
1- 5, to be assumed by the County of Grey;
NOW THEREFORE BE IT RESOLVED THAT THE COUNCIL OF
THE CORPORATION OF THE COUNTY OF GREY HEREBY ENACTS AS FOLLOWS:
1. The highways described in Schedule 'A', the general location of which is shown on
Maps 1- 5, attached hereto are hereby added to the Grey County road system, and
jurisdiction over each such highway is hereby vested in the County of Grey.
2. Schedule ‘A’ and Maps 1-5 attached hereto form and become part of this By-law.
3. This By-law shall come into force and take effect on June 1, 2027.

WHEREAS Section 52(4) of the Municipal Act, 2001 provides that an upper-tier
municipality may remove a highway, including a boundary line highway, from its system;
AND WHEREAS Section 52(5) of the Municipal Act, 2001 states that if a highway is
removed from an upper-tier highway system, it is under the jurisdiction of the lower-tier
municipality in which the highway is located;
AND WHEREAS certain lands were established as public highways under the
jurisdiction of the Corporation of the County of Grey as more particularly described in
Schedule ‘A’;
AND WHEREAS the County of Grey has undertaken a road rationalization study to
more efficiently and effectively manage its road network;
AND WHEREAS on June 25, 2026, Committee of the Whole approved road assumption
and deletion by-laws to come forward to County Council for consideration through
adoption of the Urban Road and Road Exchange Task Force minutes dated May 26,
2026, and authorized the Warden and Clerk to execute the road transfer agreements;
AND WHEREAS Council for the County of Grey deems it expedient for the lands more
particularly described in Schedule ‘A’, the general location of which is shown on Maps
1-27, to be removed from the Grey County Road System;
AND WHEREAS, without limiting the foregoing, the County of Grey owns and maintains
various traffic signals and controlled intersections on the subject roads which shall
become the responsibility of the municipality having jurisdiction of the roads, as
identified in Schedule ‘A’, as of the effective date of this By-law;
AND WHEREAS the County of Grey owns and maintains structures on the subject
roads, more particularly described in Schedules ‘B’ and ‘C’ that the County will retain as
set out herein;
NOW THEREFORE BE IT RESOLVED THAT THE COUNCIL OF
THE CORPORATION OF THE COUNTY OF GREY HEREBY ENACTS AS
FOLLOWS:
1. The highways described in Schedule ‘A’, the general location of which is shown on
Maps 1-27, are hereby removed from the County of Grey road system and upon
removal, each highway shall be under the jurisdiction of the municipality named in
Schedule 'A' in which the highway is located.
2. Without limiting the above, all traffic signals and controlled intersections which form
part of the highways described in Schedule ‘A’ shall be included as a responsibility
of the municipality having jurisdiction of the roads, as identified in Schedule ‘A’.
3. Notwithstanding Section 1 above, the structures and their approaches noted in
Schedule ‘B’, the general location of which is shown on Maps 3, 4, 6 & 7, shall
remain under the County of Grey’s jurisdiction.
4. Notwithstanding Section 1, the structure listed in Schedule ‘C’, the general location
of which is shown on Map 1, will remain under the jurisdiction of the County of Grey
while undergoing a capital improvement project and until such time as the project’s
warranty period ends.
5. Schedules ‘A’ and ‘B’ and ‘C’ and Maps 1 - 27 attached hereto form and become
part of this By-law.
6. This By-law shall come into force and take effect on June 1, 2027.

A By-Law to amend Development Charges By-law No. 5127-22
to remove the expiry date
WHEREAS Section 2(1) of the Development Charges Act, 1997, S.O. 1997, c. 27, as amended (the “Act”),
provides that the council of a municipality may enact a by-law to impose development charges against
land to pay for increased capital costs required because of increased needs for services arising from
development of the area to which the by-law applies; and
WHEREAS on December 9, 2021, the Council of the Corporation of the County of Grey enacted By-law
No. 5127-22 for the imposition of development charges for County-Wide Roads and Related Charges;
and
WHEREAS Section 19 of the Act provides that by-laws for the imposition of development charges may be
amended and that section 19(1) of the Act does not apply if the only effect of the amendment is to
repeal a provision specifying the date on which the by-law expires; and
WHEREAS the Council of the Corporation of the County of Grey deems it expedient to amend By-law No.
5127-22 to repeal section 28.0 respecting the date on which the by-law expires;
NOW THEREFORE BE IT RESOLVED THAT THE COUNCIL OF THE CORPORATION OF THE COUNTY
OF GREY HEREBY ENACTS AS FOLLOWS:
1. That By-law No. 5127-22 is hereby amended to repeal section 28.0.
2. That this By-law shall come into force and take effect upon being passed by Council.

By-law 5295-26
A By-law to confirm all actions and proceedings of the Council
WHEREAS Section 5 of the Municipal Act, 2001, as amended, states that the powers of
a municipality shall be exercised by its Council;
AND WHEREAS Section 5 (3) of the Municipal Act, 2001, as amended, provides that
municipal powers shall be exercised by by-law;
NOW THEREFORE BE IT RESOLVED THAT THE COUNCIL OF
THE CORPORATION OF THE COUNTY OF GREY HEREBY ENACTS AS FOLLOWS:
1. The actions of the Council of the Corporation of the County of Grey at its meetings
held from July 9, 2026, to date, in respect of each recommendation contained in the
Reports to Committee of the Whole, and each motion and resolution passed, and
any other actions taken by Council at these meetings are hereby adopted and
confirmed as if such proceedings were expressly embodied in this By-law.
2. The Warden and proper officers of the Corporation of the County of Grey are hereby
authorized and directed to do all things necessary to give effect to the said action, to
obtain approvals where required and to execute all documents necessary in that
behalf.
