            The Secretary-Treasurer provided an overview of the application, property
            details, and correspondence received.

            The Senior Planner provided a summary of the staff reports, including a detailed
            description of the policy framework, an overview of the facts of the applications,
            and a summary of the provisional recommendations. The Senior Planner
            recommended that the consent applications be approved subject to the

conditions outlined in Schedule 'E' of Staff Report CS-26-047 and that the minor
variance application be approved.

Chair Green inquired if the applicant or agent had any comments. Applicant, Ron
Davidson of Ron Davidson Land Use Planning Consultant Inc., was in
attendance and advised that the proposed severed lots comply with the Zoning
By-law requirements for semi-detached dwellings, and noted that any future
development on the lots will also be required to comply with all applicable Zoning
By-law provisions, including setbacks, building height, and lot coverage
requirements.
Mr. Davidson further advised that the City's Official Plan encourages a mix of
housing types and that the proposal represents low-density residential
development. With respect to the requested minor variance, Mr. Davidson
explained that it is largely technical in nature and applies only to the retained
parcel. Based on the wording of the Zoning By-law, the shorter of the two lot lines
on a corner lot is deemed to be the frontage. As the Zoning By-law requires a
minimum frontage of 12 metres and the retained parcel is proposed to have 10
metres of frontage, a minor variance is required. Mr. Davidson noted that
municipal servicing cannot be provided from 8th Avenue West, as no servicing
infrastructure exists along that street. Consequently, servicing must be provided
from 23rd Street West, which necessitates frontage on 23rd Street West for the
retained parcel. Mr. Davidson also advised that the archaeological assessment
has been completed on-site, and no archaeological resources were identified.
The final report is being prepared for submission to the Province for registration,
after which a copy will be provided to City staff.
Chair Green inquired if there were any comments from members of the public.

Mike Matejcic, resident of the Township of Georgian Bluffs, noted that he resides
near the subject property. Mr. Matejcic advised that he had no concerns with the
minor variance application; however, he expressed concerns regarding the
associated consent application. Mr. Matejcic noted that the proposed lots are
smaller than those in the surrounding neighbourhood and that the resulting
development would be inconsistent with the neighbourhood's character. Mr.
Matejcic also raised concerns related to green space, parking, snow storage,
pedestrian safety, and increased traffic, particularly given the property's proximity
to a public school. Mr. Matejcic suggested that the creation of one or two new lots
with increased frontage would be more compatible with the surrounding
neighbourhood.

Background & Proposal:
An application for a minor variance has been submitted by Jackson Penner
on behalf of Joe Watson for property located at 875 8th Avenue East.
Property Description
The subject property is an interior lot located within the southeast quadrant
of the City on 8th Avenue East between 9th Street East and 8th Street East.
The lands have approximately 12 metres of frontage on the east side of 8th
Avenue East, 30.5 metres of lot depth, and 371 square metres of lot area.
8th Avenue East is designated as a Local Road by the Transportation Plan
(Schedule ‘C’) of the City’s Official Plan.
The existing house on this lot has a similar setback to the front yard as other
houses in this area. The subject property contains an existing single
detached dwelling, detached garage, and storage shed.

Surrounding land uses include:
North: residential
East: residential
South: residential

The subject lands are designated ‘Residential’ on Schedule ‘A’ – Land Use of
the City’s 2021 Official Plan and are zoned ‘Medium Density Residential’ (R4)
by the City’s Zoning By-law (2010-078, as amended).
On April 13, 2026, City Council passed By-law No. 2026-029, being a by-law
to adopt Official Plan 2026 for the City of Owen Sound and repeal Official
Plan 2021, and By-law No. 2026-030, being a by-law to amend Zoning By
law 2010-078, for conformity with Official Plan 2026 and housekeeping
purposes (ZBA No. 57). Notices of decision on the new Official Plan and
updated Zoning By-law were issued by the City’s Deputy Clerk to the
prescribed persons and bodies under the Planning Act on April 16, 2026. The
2026 Official Plan has been referred to the County of Grey, as the approval
authority. The appeal period for Zoning By-law Amendment No. 57 has
expired. While not yet in force and effect, this report will provide an analysis
of the proposed Minor Variance in consideration of the policies of the 2026
Official Plan, as adopted by Council, and the updated zoning provisions under
ZBA No. 57.
The lands remain designated ‘Residential’ on the Land Use Plan (Schedule
‘A’) of the City’s 2026 Official Plan. The lands are zoned ‘Medium Density
Residential’ (R2) by the City’s Zoning By-law (2010-078), as amended by
ZBA No. 57.

Schedule ‘A’. For the planning policy context, please see the Official Plan and
Zoning Map in Schedule ‘B’. The subject lands are fully described in Schedule
‘C’.
The Proposal
The applicant is proposing to replace the existing covered front porch.
Section 5.8 Permitted Yard Enroachments of the City’s Zoning By-law
provides for certain features (including a porch greater than 0.75 metres
above finished grade) to project into a required yard. For the purposes of
Section 5.8 of the By-law, a required yard shall be deemed to include any

yard existing on the effective date of the By-law which is less than the
required yard. The existing dwelling has a front yard setback of 3.1 metres
(whereas 6.5 metres is required by the applicable zone).
Section 5.8 permits a porch to project 3.0 metres into the required front
yard; however, it must be setback a minimum of 1.5 metres from the front
lot line.
To facilitate the proposal, the application is requesting the following

It merits note that notice of the subject minor variance application was
provided to the prescribed persons and bodies on June 22, 2026 in
accordance with the requirements of the Planning Act. The public notice
indicated a clerical error that the provided setback of the front porch from
the front lot line is 1.2 metres, and the requested variance is 0.3 metres. In
the opinion of Planning staff, the deviation between numbers in the public
notice and considered in this recommendation report is not significant
enough to warrant additional notice. The proposal remains consistent with
the notice given, which is to facilitate a reduced front yard setback for the
proposed porch. Staff recommend that Committee proceed with hearing the
subject application on this basis and that no new notice is warranted.
Section 5.1.1 Essential Services and Utilities of the Zoning By-law notes that
the provisions of this By-law shall not limit or interfere with the construction
and maintenance of steps. As such, the steps at the front of the porch are
not required to be considered in the zoning conformity, provided that they
are located wholly on private property.

A fulsome review and analysis of the proposed minor variance is outlined
below.

Analysis:
As stipulated in the Planning Act [Sec. 45(1)], a minor variance may be
authorized by the Committee of Adjustment, provided that the four tests of a
variance are met. All decisions with respect to a planning matter must also
be consistent with the Provincial Planning Statement.
Provincial Planning Statement
The 2024 Provincial Planning Statement (PPS) has been reviewed with regard
to the proposed application. The PPS requires that settlement areas be the
focus for growth and development and land use patterns within settlement
areas should be based on densities and mix of land uses which efficiently use
land and resources, optimize existing and planned infrastructure and public
service facilities, and support active transportation. Planning authorities are
required to support general intensification and redevelopment to support the
achievement of complete communities. The subject lands are within a fully
serviced settlement area. Minor, continued development of an existing,
serviced residential property is consistent with the direction provided by the
PPS subject to the recommended conditions.
County of Grey Official Plan
The City of Owen Sound is designated as a ‘Primary Settlement Area’ in the
2019 County of Grey Official Plan (County OP). The County OP promotes a
full range of land uses within Primary Settlement Areas. Land use policies
and development standards are to be in accordance with the local Official
Plan. The County was provided notice of the application in accordance with
the requirements of the Planning Act and have no objections to the
requested variance.
Test 1: Conformity with the Official Plan
The subject property is designated ‘Residential’ on Schedule ‘A’ – Land Use of
the City’s 2021 Official Plan (OP). Where lands are designated Residential,
residential and related uses are to be the predominant land use. Single and
semi-detached dwellings are among the residential uses permitted within this
designation. The OP generally supports site revitalization and redevelopment.

Section 8 of the OP provides Urban Design direction and supports relatively
consistent streetscapes and compatible built form. Within a residential area,
heights and setbacks should be consistent with the general form of existing
development (8.6.1.3). The subject property is in a diverse neighbourhood
which includes a range of building types including 1.5 and two-storey red
brick dwellings as well as split-level and single-storey bungalows. This
portion of 8th Avenue East has a well-established front yard streetscape and
front yard. The existing porch is similar to others in this area.
The proposed covered front porch will not significantly change the
established streetscape as it will be similarly sized and located to the existing
structure. A recommended condition of approval will require that the
boulevard tree (English Oak in excellent condition) have appropriate
hoarding and protection at the time of construction to the satisfaction of the
City’s Manager of Parks and Open Space.
Under the City’s 2026 OP, the lands remain designated ‘Residential’. Policies
respecting the Residential land use designation and Urban Design remain
unchanged.
The proposal conforms with the City’s Official Plan, subject to recommended
conditions.

By law (2010-078, as amended). Single detached dwellings are among the
permitted uses in the R2 zone.

maintain relatively consistent streetscapes (as discussed in the OP section
above) and to ensure that there is sufficient room in the front yard for the lot
to function without encroaching onto the road allowance. Functional
attributes of a front yard may include:

Snow storage & stormwater management;
Underground and above-ground utilities and appurtenances; and
Parking.

In this case, as the applicant is proposing the replacement of an existing
structure in the same general location, there is no anticipated impact to the
function of the technical front yard. The house has a detached garage and
driveway on the south side of the building and therefore does not require the
front yard for parking.
The proposed development will not alter the existing situation regarding
snow storage and stormwater management. Engineering Services Division
has not requested a grading and drainage plan and recommends approval of
the application.
The covered front porch and steps will be located entirely on the subject
property with no encroachment onto the City’s boulevard/road allowance.
Under the City’s Zoning By-law 2010-078, as amended by ZBA No. 57, the
lands are zoned ‘Medium Density Residential’ (R2). Single detached dwellings
are permitted within the R2 Zone. Provisions regarding permitted yard

encroachments are unchanged in Section 5 of the City’s Zoning By-law as
amended by ZBA No. 57.
The proposal maintains the general intent and purpose of the City’s Zoning
By-law.
Test 3: Minor in Nature
The request for relief from the front yard setback requirements of Section
5.8 of the Zoning By-law to allow the replacement of an existing porch can
be considered minor in nature for a number of reasons, as follows:





The proposal will maintain an existing permitted residential use of
the lands and facilitate a renovation/replacement.
The proposed replacement is in the same general location as the
existing porch. The anticipated impact on adjacent properties and
the surrounding neighbourhood is extremely limited.
The proposal does not compromise the function of the property.
The subject property can continue to provide for adequate parking,
access and snow and stormwater management.

Test 4: Desirable for the Development and Use of the Lands
The proposed development represents redevelopment within a settlement
area that is supported by the policies of the PPS and the City’s OP.
The requested relief will provide for improvements to an existing permitted
residential use. The proposal is deemed to be desirable for the development
and use of the lands.

200/96), notice of the subject application was provided on June 22, 2026 to

A Consent Application (B09-2026) has been submitted by J. Andrew
L. Wilson, for property municipally known as 768 3rd Avenue West.
The application proposes to sever the subject property for the
purposes of creating one (1) new residential building lot have 20
metres of frontage on 3rd Avenue ‘A’ West, 18.4 metres of lot
depth, and 368 square metres of lot area. A single detached
dwelling is proposed to be constructed on the severed parcel.
The lands are also subject to Minor Variance Application A07-2026,
which requests relief from the provisions of the Zoning By-law to
facilitate the proposed lot creation and the construction of a single
detached dwelling on the severed parcel. A fulsome analysis of the
requested variance is provided in Staff Report CS-26-069, in
consideration of the four tests provided by the Planning Act.
Staff recommend approval of the subject consent application,
subject to conditions.

APPEAL BOARD REGARDING THE REGULATION AND CONTROL OF DOGS
The Committee of Adjustment is now sitting as the Appeal Board regarding the
Regulation and Control of Dogs.
By-law No. 2024-113 being "A By-law to Licence, Regulate and Control Dogs
Within the City of Owen Sound" gives the Appeal Board the power to reverse or
uphold the officer's finding.
The onus is on the appellant to provide evidence satisfactory to the Appeal
Board that the relief being sought should be granted.
Please be advised that if anyone other than the owner or their representative
wishes to receive notice of the decision of the Appeal Board, or in the event that
the Appeal Board defers its decision respecting the appeal, such person or
persons must leave their names and addresses in writing with the Secretary of
the Appeal Board prior to leaving the hearing by filling out the sign-in sheet
located on the table just outside of Council Chambers.
In addition, where more than six months have elapsed since the matter was
before the Appeal Board, and the owner believes that the behaviour of the dog
has improved, the owner may apply to the Appeal Board by notifying the
Secretary in writing setting out the grounds for the belief that the dog's
behaviour has improved and requesting an order modifying or rescinding the
order to muzzle, leash, or both.
