7 APPLICATIONS

The Committee of Adjustment held a public hearing for minor variance application A-082-25 regarding Troy and Megan Cloutier's proposal to sever lands at 242nd Avenue East and construct two semi-detached dwellings. Staff recommended approval subject to conditions including archaeological assessment review, driveway reconstruction, and tree preservation, and the Committee approved the motion for approval of application A-082-25. Subsequently, the Committee considered a consent application for severance at 242nd Street East to create a new lot for a semi-detached dwelling, noting that no variance was required as standards were met. The committee recommended approval of application B-082-25, subject to conditions requiring an archaeological assessment, decommissioning the existing driveway on 3rd Avenue East road allowance, reinstating the boulevard with topsoil, sod, or seed, submitting grading and drainage and servicing plans, and paying outstanding frontage charges for watermain, wastewater, sewer, storm sewer, sidewalk, urban roadway, and engineering review fees. A motion to approve the application was moved and carried, concluding the public hearing for B-082-25 with a twenty-day appeal period declared. The Committee of Adjustment also considered a severance application to create one new residential lot on lands known municipally as 1663 5th Avenue East, retaining an existing dwelling and creating a vacant lot with approximately 16 metres of frontage.

00:08:55 Speaker 02: The Committee of Adjustment today will consider two minor variance applications scheduled under applications.

00:09:01 Speaker 02: The Planning Act requires that a public hearing be held before the Committee of Adjustment decides whether to approve the minor variance.

00:09:13 Speaker 02: The public hearing serves two purposes: first, to present the details and background of the application to the Committee of Adjustment and the public; and second,

00:09:22 Speaker 02: to receive comments from the public or agencies before a decision is made.

00:09:29 Speaker 02: For each application, the Secretary-Treasurer will summarise the proposal and correspondence on file.

00:09:37 Speaker 02: Planning staff will provide other information that is relevant to the application.

00:09:41 Speaker 02: From there, the applicant will be provided with the opportunity to make a presentation, followed by any questions or presentations from the public, either in favour or in opposition to the application.

00:09:53 Speaker 02: All questions should go through me, the Chair, and presentations are limited to a maximum of 10 minutes.

00:09:59 Speaker 02: Committee members will then have the opportunity to question the applicant, the Secretary-Treasurer, the planner, or anyone giving a presentation.

00:10:09 Speaker 02: The application will then be considered by the Committee.

00:10:12 Speaker 02: Will the Secretary-Treasurer please advise how, when, and to whom the notice of public hearings was circulated?

00:10:23 Speaker 02: Through you, Mr. Chair.

00:10:24 Speaker 04: Notice for these applications was posted on the subject properties on Tuesday, May 13, 2025, being at least 14 days prior to the hearing.

00:10:32 Speaker 04: Notice for these applications was sent by mail to the assessed owners within 60 metres of the subject properties, and was also circulated to those persons, departments,

00:10:40 Speaker 04: and agencies likely to have an interest in the applications, as legislated.

00:10:45 Speaker 04: Included with each notice was a legal description of the subject property and a description of the purpose of the proposed consent or minor variance.

00:10:52 Speaker 04: The circulations were provided in accordance with the provisions of the Planning Act.

00:10:58 Speaker 02: I now declare this to be a public hearing for application A-082-25.

00:11:05 Speaker 02: Miss Bennett, will you please summarise the application and any correspondence received to date?

00:11:12 Speaker 04: Through you, Mr. Chair, this is a minor variance application that was put forward by Troy and Megan Cloutier on behalf of Greyrose Inc. The Official Plan designation is residential,

00:11:21 Speaker 04: and it is zoned as low-density residential R-2.

00:11:24 Speaker 04: The legal description of the lands is Plan 56, Lot 7 to 8, City of Owen Sound, County of Grey, and it is known municipally as 242nd Avenue East.

00:11:34 Speaker 04: The applicant is proposing to sever the subject lands to create one new residential lot.

00:11:38 Speaker 04: The applicant is proposing to demolish the existing dwelling and construct two semi-detached dwellings, one unit on each of the retained and severed lots.

00:11:46 Speaker 04: To facilitate the consent, a minor variance is being requested to address deficiencies on the severed and retained lots.

00:11:52 Speaker 04: Comments have been received without objection from the City of Owen Sound Engineering and Public Works Department and Building Division, the Historic Saugeen Métis, Grey County, and the Grey-Sable Conservation Authority.

00:12:04 Speaker 04: Thank you very much, Planning Staff.

00:12:06 Speaker 02: Will you provide any additional information that may be relevant?

00:12:11 Speaker 02: Through you, Chair.

00:12:12 Speaker 02: Thank you.

00:12:13 Speaker 05: This property, just described by the Secretary-Treasurer, is located on a corner lot close to Harrison Park, with frontage on Second Street East and Third Avenue East.

00:12:27 Speaker 05: It's an existing dwelling there.

00:12:29 Speaker 05: It's located very close to the southeast corner of the property and may even encroach onto Third Avenue East Boulevard.

00:12:35 Speaker 05: The existing driveway is certainly at least partially, if not mostly, on city property.

00:12:41 Speaker 05: The lot is proposed to be severed for a semi-detached dwelling, one dwelling unit for each of the new and retained lots, and requires specific variances specifically on front yard setback, rear yard setback,

00:12:56 Speaker 05: and interior side yard setback for the retained parcel, and front yard setback and rear yard setback for the severed parcel.

00:13:06 Speaker 05: It's important to note that no minor variances are requested for the lot area or frontage, so the lot creation is not requiring these variances.

00:13:15 Speaker 05: It's for the specific dwelling that's being proposed, while a variance is requested for front yard setback; garages are shown to be setback more than six metres.

00:13:25 Speaker 05: Staff have reviewed the application against the policy context and the four tests for minor variance, finding that the application is consistent with the direction of the PPS, conforms to the official plan,

00:13:37 Speaker 05: maintains the intent and purpose of the zoning bylaw, is minor in nature, and desirable for the development and use of the lot, provided the conditions recommended are applied, which I will summarise for the committee.

00:13:51 Speaker 05: First, that approval of the consent is obtained; that construction occurs substantially in accordance with the sketch;

00:13:59 Speaker 05: that any surface parking stall shall provide a minimum of 2.6 metres by 6 metres if located in the front yard having direct access to Second Street West;

00:14:11 Speaker 05: that any existing driveway be removed and the boulevard reconstructed prior to a building permit being issued for any new construction;

00:14:18 Speaker 05: and that a tree preservation and planting plan for the severed and retained lots be provided.

00:14:23 Speaker 05: This is recommended in part as there are existing trees along the westerly boundary with the neighbour that are not shown on the plan, and it's unclear if they will be impacted by the development.

00:14:34 Speaker 05: So we want to see that and make sure that they are considered in the development of the lands.

00:14:41 Speaker 05: That's my summary.

00:14:42 Speaker 05: If there are any questions, happy to answer them.

00:14:44 Speaker 05: Thank you very much.

00:14:47 Speaker 05: I may get back to you.

00:14:50 Speaker 02: Does the applicant agent for A082025 have a presentation they wish to make?

00:14:57 Speaker 02: I don't have a presentation.

00:15:03 Speaker 02: Are there any questions or comments from members of the public?

00:15:09 Speaker 02: we shall proceed.

00:15:14 Speaker 02: Are there any further questions or comments from the committee to the applicant, Secretary-Treasurer, planning staff?

00:15:24 Speaker 02: Seeing none.

00:15:25 Speaker 02: Sorry, just one quick question.

00:15:27 Speaker 02: From it was that we...

00:15:28 Speaker 06: I know we got it a little late about the archaeological assessment that needed to get done.

00:15:33 Speaker 06: Is that just in?

00:15:35 Speaker 06: Is that... was that just added to Schedule F for just like approval of this, or does this not really pertain to our approval at this level?

00:15:49 Speaker 05: Through you, Chair, the condition is part of the next report, which is for the consent.

00:15:55 Speaker 05: So it is recommended, but it's being recommended as part of the consent application.

00:16:01 Speaker 05: Perfect.

00:16:01 Speaker 05: I just looked at the wrong one.

00:16:02 Speaker 05: That one.

00:16:03 Speaker 05: Okay.

00:16:03 Speaker 05: Thanks.

00:16:04 Speaker 05: Thank you, Marcus.

00:16:07 Speaker 02: Does any member of the committee wish to make a motion for?

00:16:12 Speaker 02: application A082025?

00:16:19 Speaker 02: Yes, Chair.

00:16:20 Speaker 03: I would like to make a motion for approval of A082025.

00:16:27 Speaker 03: Thank you.

00:16:28 Speaker 03: I'll call all in favour.

00:16:33 Speaker 03: Marcus.

00:16:33 Speaker 03: Thank you.

00:16:37 Speaker 03: The motion is carried.

00:16:39 Speaker 02: Please be advised that there is a twenty-day appeal period, during which time the applicant, the minister, or specified person or public body has an interest in the matter, may appeal today's decision.

00:16:50 Speaker 02: During the appeal period, no building permit may be issued or other work commenced.

00:16:55 Speaker 02: I now declare public hearing for A082025 to be concluded.

00:17:00 Speaker 02: The applicant may leave the meeting if they wish to do so.

00:17:20 Speaker 02: Apologies.

00:17:21 Speaker 02: Thank you, Mr. Chair.

00:17:22 Speaker 04: The next application is a consent application, again put forward by Troy and Megan Cloutier on behalf of Grey Rose Inc. The official plan designation is residential, and it is zoned as low density residential R2.

00:17:31 Speaker 04: The legal description of the lands is Plan 56 of the lands is Plat 56 Lot 7 to 8, City of Owen Sound, County of Grey, and it is known municipally as 242nd Street East.

00:17:42 Speaker 04: The applicant is proposing to sever the subject lands to create one new residential lot.

00:17:46 Speaker 04: The applicant is proposing to demolish the existing dwelling and construct two semi-detached dwelling units, one on each of the retained and severed lots.

00:17:54 Speaker 04: The severed lot is proposed to have approximately 15.77 metres of frontage on Second Street East, 22 metres of lot depth, and 318.97 square metres of lot area.

00:18:06 Speaker 04: The retained lot is proposed to have approximately 15.8 metres of frontage on Second Street East, 20.2 metres of frontage on Third Avenue East, and 310.14 square metres of lot area.

00:18:19 Speaker 04: Comments have been received without objection from the City of Owen Sound Engineering and Public Works Division and Building Division, Sauguenai Nation, Historic Saugene Métis, Grey County, and the Grey-Sable Conservation Authority.

00:18:30 Speaker 04: Conditions recommended by the Sauguenai Nation and the City of Olmstead Engineering and Public Works Department are included in Schedule E to the staff report.

00:18:43 Speaker 04: Thank you very much.

00:18:44 Speaker 02: Planning staff, will you please provide any additional information that may be relevant?

00:18:50 Speaker 02: Certainly, through you, Chair.

00:18:51 Speaker 05: This is, as Alastair mentioned, the same property that we just discussed with A082025.

00:18:57 Speaker 05: This is the actual severance application to create the new lot for a semi-detached dwelling, which staff found meets all development standards and applicable policies.

00:19:07 Speaker 05: Specifically, it meets the frontage and area required for a semi-detached dwelling, so no variance is required to create the lot.

00:19:15 Speaker 05: With respect to the official plan and the provincial policy statement, they both support infill and redevelopment in a settlement area where the lots have access to full municipal services.

00:19:25 Speaker 05: And with respect to the question that had just come up, there was a comment from the Saugeen Ojibway Nation requesting that built archaeological resources on this subject lands be reviewed through an archaeological assessment.

00:19:43 Speaker 05: Staff did contact Saugeen Ojibway Nation to discuss this request with respect to the existing development on the lot to clarify the process, but they did not respond prior to this meeting.

00:19:54 Speaker 05: So, a condition is recommended that you'll see about that.

00:19:59 Speaker 05: So, in summary, the conditions for the new lot creation would require deeds for stamping, that a survey be prepared by a qualified land surveyor, that the applicant pay cash in lieu of parkland,

00:20:11 Speaker 05: confirm that their taxes have been paid, provide evidence that the existing buildings have been removed, or demonstrate compliance with the city's zoning bylaw to the satisfaction of the planning division.

00:20:24 Speaker 05: That is recommended because the proposed lot is undersized for a single detached dwelling; the recommendation that the applicant provide an archaeological assessment.

00:20:36 Speaker 05: The applicant is to decommission the existing driveway that is on Third Avenue East road allowance, and reinstate the boulevard with topsoil, sod, or seed.

00:20:47 Speaker 05: That the applicant prepare and submit a grading and drainage plan, a servicing plan, and that they pay outstanding frontage charges for watermain, wastewater and sewer, storm sewer, sidewalk and urban roadway,

00:21:00 Speaker 05: and pay the engineering review fee.

00:21:04 Speaker 05: Thank you very much.

00:21:05 Speaker 02: Does the applicant or agent for B082025 have a presentation they wish to make?

00:21:12 Speaker 02: Silence.

00:21:16 Speaker 02: Are there any questions or comments from members of the public?

00:21:19 Speaker 02: here, we move on.

00:21:20 Speaker 02: Are there any further questions or comments from the committee to the applicant, Secretary-Treasurer, Planning Division, or any other persons?

00:21:29 Speaker 02: No, not from you, Marcus.

00:21:32 Speaker 02: No, no. Thank you.

00:21:35 Speaker 02: Does any member of the committee wish to make a motion for application B-082-25?

00:21:41 Speaker 02: Yes, Chair.

00:21:46 Speaker 03: I'd like to make a motion to approve application B-082-25, subject to the conditions.

00:21:59 Speaker 03: Thank you.

00:22:00 Speaker 03: I'll call the vote.

00:22:01 Speaker 03: All those in favour.

00:22:03 Speaker 03: Thank you.

00:22:03 Speaker 03: The motion is carried.

00:22:05 Speaker 02: Please be advised that there is a twenty-day appeal period during which time the applicant, the minister, or specified persons or public body that has an interest in the matter may appeal today's decision.

00:22:18 Speaker 02: During this appeal period, no building permit may be issued or other work commenced.

00:22:23 Speaker 02: I now declare public hearing for B-082-25 to be concluded.

00:22:27 Speaker 02: The applicant may leave the meeting now if they wish to do so.

00:22:38 Speaker 02: I now declare this to be a public hearing for application B-092-25.

00:22:44 Speaker 02: Miss Pinner, will you please summarise the application and any correspondence received to date?

00:22:48 Speaker 02: Thank you, Mr. Chair.

00:22:52 Speaker 04: This is a consent application that was put forward by Ron Davidson on behalf of Keith Miles.

00:22:56 Speaker 04: The official plan designation is residential, and it is zoned as R4.

00:23:02 Speaker 04: The legal description of the lands is Plan Owen Sound, Lots four and five, Part Lot three East High Street North, St. Vincent Street, Part Lots three to five West, Princess Street North, St. Vincent Street,

00:23:12 Speaker 04: City of Owen Sound, County of Grey, and it is known municipally as 1663 Fifth.

00:23:17 Speaker 04: 1663 Fifth Avenue East.

00:23:19 Speaker 04: The applicant is proposing to sever the subject lands to create one new residential building lot.

00:23:27 Speaker 04: The retained lot is proposed to have approximately 45.5 metres of frontage on Fifth Avenue East, 76.67 metres of depth, and 1,226.72 metres squared of lot area, and contains an existing single detached dwelling, pool,

00:23:40 Speaker 04: and accessory structures.

00:23:42 Speaker 04: The vacant severed lot is proposed to have approximately 16 metres of frontage on Fifth Avenue East, 76.67 metres of depth, and 1,226.72 metres squared of lot area.

00:23:53 Speaker 04: Comments have been received without objection from the City of Owen Sound Planning and Engineering and Public Works Division and Building Division, Grey County, and the Grey Sauble Conservation Authority.

00:24:04 Speaker 04: Following the publication of the agenda, one public comment was received, which I will read now for the benefit of the committee.

00:24:12 Speaker 04: I am concerned about the proximity of any potential new neighbourhood or any potential new neighbour structure, given the narrow width of the proposed severance.

00:24:19 Speaker 04: The R4 zoning bylaw states medium-density residential, which would allow up to four lower-rise units as well as other development structures.

00:24:26 Speaker 04: Many factors opposing this severance include noise due to construction, heavy equipment, and the possibility of persistent noise due to the density of multiple units.

00:24:35 Speaker 04: Granting such a severance would permit a two-story structure for multiple residents and considerable depth of construction.

00:24:42 Speaker 04: Inevitably, any situation for severance will increase noise, perhaps without consideration for other neighbours.

00:24:49 Speaker 04: I fully oppose the proposed severance of 52 feet, approximately lot.

00:24:53 Speaker 04: Kind regards.

00:24:57 Speaker 04: Thank you very much.

00:24:58 Speaker 02: It's a shame that person isn't here.

00:25:00 Speaker 02: I'd like to know what noise they were referring to.

00:25:03 Speaker 02: Construction noise, yes, but after that, it would be a question for the person writing the letter.

00:25:11 Speaker 02: Planning staff, would you please provide any additional information that may be relevant?

00:25:19 Speaker 02: Yes, through you, Chair.

00:25:21 Speaker 05: The Secretary-Treasurer has described the applications and the comments received.

00:25:25 Speaker 05: In summary of the report, this is a property located on the top of the East Bluff, just north of St. Mary's, and contains an existing dwelling known as the John McLean Home.

00:25:36 Speaker 05: This property was subject of a previous consent in 2013, which can be seen with the new single detached dwelling constructed just to the north of the retained lot here.

00:25:48 Speaker 05: It was also subject of a severance application in 2021, which has lapsed.

00:25:54 Speaker 05: The proposal that we are before us today has been assessed under the 2025 policy framework.

00:26:01 Speaker 05: It represents an infill lot in a built-up area of the city with access to full municipal services.

00:26:07 Speaker 05: The new lot exceeds the frontage and area requirements for a single detached dwelling in the R4 zone, and the John McLean home is listed on the city's heritage register,

00:26:18 Speaker 05: but is not designated under the Ontario Heritage Act.

00:26:22 Speaker 05: And no change is proposed to the existing building itself, which is the built heritage attribute identified in comments from the heritage staff in 2021.

00:26:33 Speaker 05: The application does not prevent the future designation of the home, but staff are not recommending designation as part of this application.

00:26:42 Speaker 05: The provincial direction supports new housing development where available services can be provided by the city.

00:26:51 Speaker 05: Staff find the proposal satisfies the policy context, including the provincial policy statement, the official plan, and the zoning bylaw, subject to conditions, which I will summarise.

00:27:02 Speaker 05: That the applicant provide deeds for stamping.

00:27:05 Speaker 05: That a survey showing the foundations of both the existing and the proposed substructures be provided, and that's to account for the proximity of the proposed new lot to the existing structures.

00:27:17 Speaker 05: Those setbacks weren't provided on the site plan, so we just want to make sure we're not creating a non-conformity before the deeds get stamped.

00:27:26 Speaker 05: That the applicant pay cash in lieu of parkland, provided confirmation that the taxes have been paid.

00:27:32 Speaker 05: That prior to any development of the lot, a plan be provided demonstrating existing trees to be removed and trees to be planted, and that for each mature tree to be removed,

00:27:42 Speaker 05: it shall be replaced with two trees, or a capital contribution for city planting of street trees if there isn't room on site.

00:27:51 Speaker 05: That the applicant provide a survey to demonstrate the existing infrastructure is wholly located on the retained lot, with an alternative option provided should it be necessary that it be relocated at the owner's expense,

00:28:08 Speaker 05: that the applicant prepare and submit a grading and drainage plan, a servicing plan with servicing arrangements acceptable to the city, and that they pay outstanding charges for watermain, wastewater sewer, sidewalk, urban roadway,

00:28:23 Speaker 05: and engineering review fees.

00:28:27 Speaker 05: Thank you very much.

00:28:28 Speaker 05: Does the applicant or agent?

00:28:30 Speaker 07: Agents or agents have a presentation they wish to make.

00:28:35 Speaker 07: Yes.

00:28:35 Speaker 07: Good afternoon.

00:28:37 Speaker 07: My name is Ron Davidson.

00:28:38 Speaker 08: I'm a planning consultant, and I filed the application on behalf of Keith Miles, who is sitting here today.

00:28:44 Speaker 08: I shall be very brief.

00:28:45 Speaker 08: It's a very straightforward consent application.

00:28:48 Speaker 08: Keith has a very wide and a very deep lot, and as you heard, he's got his house and his pool and a couple of accessory buildings on the property.

00:28:57 Speaker 08: They're on the north side, and he simply wants to sever off a lot on the south side,

00:29:02 Speaker 08: and there's lots of room to do that in this day and age of provincial policy and county policy and city policy in terms of intensification and infilling and efficient use of municipal service land.

00:29:16 Speaker 08: This makes a whole lot of sense.

00:29:18 Speaker 08: The property is about currently about 11 times larger than what the minimum lot area requirement is.

00:29:25 Speaker 08: So there's severing the two pieces makes a whole lot of sense, given the location of the house.

00:29:32 Speaker 08: Though there's not an option to create any more lots in the future, at least I don't think there is.

00:29:38 Speaker 08: You heard from a neighbour.

00:29:41 Speaker 08: She raised or he raised or they raised two concerns.

00:29:44 Speaker 08: One with regard to the narrow width.

00:29:46 Speaker 08: Just to keep in mind that the bylaw requires a width of 12 metres, and the proposal is for a 16-metre wide lot.

00:29:55 Speaker 08: That's actually quite large.

00:29:57 Speaker 08: Typically, nowadays in a new subdivision, for example, the lots would be between 12 and 15 metres wide.

00:30:02 Speaker 08: So 16 is a good, healthy size lot.

00:30:05 Speaker 08: And I share the same question that the chair has had about noise.

00:30:10 Speaker 08: If we're talking about construction, you know, I don't know what to say other than you got to break a few eggs to make an omelet.

00:30:17 Speaker 08: That's that's about it.

00:30:18 Speaker 08: That's all I have for my presentation.

00:30:21 Speaker 08: Thanks.

00:30:22 Speaker 08: Thank you very much.

00:30:29 Speaker 02: There's no members of the public here, so we'll move on.

00:30:32 Speaker 02: Are there any questions or comments from the committee to the applicant, Secretary of Planning Division, or any persons made a presentation?

00:30:42 Speaker 02: Seeing none, move on.

00:30:46 Speaker 02: Does any member of the committee wish to make a motion for application B-092-25?

00:30:51 Speaker 02: Yes, Chair.

00:30:56 Speaker 03: I'd like to make a motion to accept B-092-25, subject to the conditions.

00:31:09 Speaker 03: Thank you very much.

00:31:10 Speaker 03: I will call a vote.

00:31:11 Speaker 03: All those in favour?

00:31:13 Speaker 03: Aye.

00:31:14 Speaker 03: Marcus.
